Terms of Service

1. Acceptance of Terms

By accessing or using KidooTrack's daycare management platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

If you are using the Service on behalf of a daycare organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

KidooTrack provides a daycare management platform that includes student management, attendance tracking, curriculum planning, parent communication, staff coordination, and related features. The Service is accessible via web and mobile applications.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

Account types include Daycare Administrator, Staff, and Parent, each with different access levels and permissions as described in our documentation.

4. Acceptable Use

You agree to use the Service only for lawful purposes related to daycare management. You agree not to:

• Use the Service to store or transmit content that violates any law
• Attempt to gain unauthorized access to other users' data or other daycare organizations' data
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to collect or harvest personal information for unauthorized purposes
• Share your account credentials with unauthorized persons
• Use the Service in any way that could harm children or violate children's privacy

5. Data Ownership and Responsibility

You retain ownership of all data you enter into the Service. KidooTrack does not claim any ownership rights to your content. You are responsible for the accuracy and legality of the data you provide.

As a daycare operator, you are responsible for obtaining appropriate consent from parents and guardians before entering children's information into the system. You must comply with all applicable privacy laws regarding children's data.

6. AI Features

The Service includes AI-powered features such as curriculum planning and theme suggestions. These features are provided as tools to assist educators and should not be used as the sole basis for educational decisions. AI-generated content should be reviewed by qualified educators before implementation.

No student personal information is shared with AI models. AI features use only generic educational parameters such as grade level and month to generate suggestions.

7. Data Separation

Each daycare organization's data is kept completely separate. You acknowledge that you can only access data within your own daycare organization, and any attempt to access another organization's data is a violation of these Terms.

8. Payment Terms

Pricing is determined on a per-organization basis. Payment terms, including billing frequency and pricing details, will be agreed upon separately and are subject to a separate service agreement.

9. Service Availability

We strive to provide 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for service interruptions beyond our reasonable control.

10. Termination

Either party may terminate the use of the Service at any time. Upon termination, you may request an export of your data within 30 days. After 30 days, your data will be securely deleted in accordance with our data retention policy.

We may suspend or terminate your account immediately if you violate these Terms or if continued use poses a risk to the Service or other users.

11. Limitation of Liability

To the maximum extent permitted by law, KidooTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. Our total liability shall not exceed the amount paid by you to us in the 12 months preceding the claim.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.
